LumoraClear Terms of Service

Welcome to LumoraClear ("LumoraClear," "we," "us," or "our"). LumoraClear provides an independent, consumer-facing application designed to help individuals access, organize, and understand their medical billing and insurance information using patient-authorized data.
By accessing or using the LumoraClear application or website (the "Services"), you agree to these Terms of Service ("Terms"). If you do not agree, you may not use the Services.
1. Eligibiility
You must be at least 18 years old or have appropriate legal authority to use LumoraClear. Caregivers may use the Services on behalf of another individual only where permitted by law and with documented authorization.
2. User Authorization & "Right of Access"
LumoraClear accesses health and insurance information only with your explicit authorization.
- Authorized Representative: By using LumoraClear, you explicitly appoint LumoraClear as your authorized representative for the purpose of exercising your "Right of Access" under HIPAA (45 CFR § 164.524). You authorize us to connect to your insurance carrier's APIs (including HL7 FHIR-based APIs) to retrieve your billing data on your behalf.
- Data Use: We use this data solely to provide the billing audit and organization services you request. We do not write, submit, or modify claims on your behalf.
3. No Professional Advice; Informational Use Only
LumoraClear is an informational and financial advocacy tool.
- No Medical Advice: We are not healthcare providers. The Services should not be relied upon as a substitute for professional medical advice, diagnosis, or treatment.
- No Financial/Legal Advice: While we help identify potential billing discrepancies, we do not provide professional financial or legal advice. Any decision to dispute a bill or withhold payment is made at your own risk.
4. Data Accuracy & Third-Party Sources
LumoraClear retrieves data directly from third-party insurance payers and providers.
- "As-Is" Data: We are not responsible for the accuracy, completeness, or timeliness of the information provided by these third parties. If your insurance carrier has an error in their records, that error will be reflected in our Services.
- No Liability for Claims Errors: Since we do not create or submit medical claims, LumoraClear is not liable for any errors contained within the source billing data.
5. Privacy & Data Protection
Your privacy is our priority. Our data handling is governed by our Privacy Policy, which includes our Model Privacy Notice (MPN) snapshot.
- No Sale of Data: LumoraClear does not sell, rent, or lease your personal health information.
- Security Standards: We maintain a security program modeled after the NIST Cybersecurity Framework, utilizing AES-256 encryption for data at rest and TLS 1.2+ for data in transit.
6. User Responsibilities
You agree to:
- Provide accurate information and maintain the confidentiality of your login credentials.
- Use the Services in compliance with all applicable local, state, and federal laws.
- Not misuse, reverse engineer, or attempt to gain unauthorized access to our systems.
7. Limitation of Liability
To the maximum extent permitted by law, LumoraClear shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the Services. While we implement rigorous safeguards, please be aware that no electronic storage or transmission is 100% secure.
Our total liability for any claim arising out of these Terms shall not exceed the amount you paid us (if any) to use the Services during the previous 12 months.
8. Modifications & Termination
- Termination: You may stop using the Services and revoke your data authorization at any time.
- Changes: We may update these Terms to reflect regulatory changes. Continued use of the Services after an update constitutes acceptance.
